Mortgage & Financial Property Disputes

A demand notice from a bank, a property listed for auction, or original documents a lender will not return after the loan is closed — financial property disputes run on strict timelines. NyayGo reviews the loan and property papers and coordinates an independent enrolled advocate quickly.

Where these disputes are decided

Banks and financial institutions enforce secured loans under the SARFAESI Act, 2002, starting with a demand notice and potentially leading to possession and auction. A borrower or affected person can challenge measures taken under the Act before the Debts Recovery Tribunal (DRT), within time limits. Disputes about releasing title documents after a loan is repaid can also be raised with the lender’s grievance process and the banking ombudsman.

FAQ

Common questions

I received a SARFAESI demand notice. What now?

The notice usually gives 60 days to pay or respond. A borrower can send a representation to the bank, and later measures can be challenged before the Debts Recovery Tribunal. Timelines are short, so get advice promptly.

The bank won’t return my property papers after I repaid the loan. What can I do?

Start with a written request and the bank’s grievance process; if that fails, the banking ombudsman and legal action are possible routes. A legal notice often moves things quickly.

Can NyayGo guarantee the result?

No. Outcomes depend on the facts, the evidence and the law, and no one can lawfully guarantee a result. The advocate on your matter will explain the options and the risks.
