Wills, Gifts & Property Transfer Disputes
A will that appears out of nowhere, a gift deed signed under pressure, or a relinquishment a family member now regrets — transfer documents are often challenged long after they are signed. NyayGo reviews the documents and coordinates an independent enrolled advocate.
Where these disputes are decided
Wills are proved, or challenged, in probate or letters-of-administration proceedings, or in a civil suit — common grounds include lack of capacity, undue influence and suspicious circumstances. A registered gift deed is generally difficult to revoke, though it can be challenged for fraud, coercion or undue influence; senior citizens also have a specific remedy under the Maintenance and Welfare of Parents and Senior Citizens Act, 2007 where a gift was conditional on care.

Common questions
Can a registered gift deed be cancelled?
Generally only in limited situations — for example fraud, coercion or undue influence, or where a senior citizen gifted property on the condition of being cared for and that condition was not met. Each case depends on its facts.
On what grounds can a will be challenged?
Common grounds include that the person lacked mental capacity, was under undue influence or coercion, the will was not properly executed and witnessed, or the circumstances around it are suspicious.
Can NyayGo guarantee the result?
No. Outcomes depend on the facts, the evidence and the law, and no one can lawfully guarantee a result. The advocate on your matter will explain the options and the risks.
